By accessing or using LabNow's services, website, or mobile applications, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
LabNow operates as a specimen collection center. We provide blood and specimen collection services and coordinate processing with independent, CLIA-certified third-party laboratories. LabNow is not a clinical laboratory and does not perform diagnostic testing on site. We offer walk-in and mobile collection services, appointment scheduling, and optional clinical review of laboratory results.
LabNow is not a physician practice and does not provide medical care, diagnosis, or treatment. Any laboratory testing is ordered by a licensed healthcare provider where required by law. Information provided through our services, including laboratory results, is for informational purposes only and is not a substitute for professional medical advice. You should always consult with your primary care physician or other qualified healthcare provider regarding any questions about your health or laboratory results.
You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms of Service. For minors, services must be requested by a parent or legal guardian.
To use certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
Appointments can be scheduled through our website or by contacting us directly. We reserve the right to confirm, reschedule, or cancel appointments as necessary. If you need to cancel or reschedule an appointment, please provide at least 24 hours notice. Failure to appear for a scheduled appointment without prior notice may result in cancellation fees.
Payment is due at the time of service unless other arrangements have been made. We accept various payment methods as indicated on our website. Prices for our services are subject to change without notice. You are responsible for all charges incurred under your account, including applicable taxes and fees. Refunds are provided at our discretion and in accordance with our refund policy.
Specimens collected by LabNow are sent to independent third-party laboratories for analysis. These laboratories establish their own methodologies, quality standards, and pricing. Laboratory results are typically available within 24-48 hours but may vary depending on the specific tests ordered. We will notify you when results are available. Results are provided through secure channels and may require identity verification.
Optional clinical review services are provided by independent licensed healthcare providers, not by LabNow. Clinical review is an additional service with separate fees. The healthcare provider will review your laboratory results and may provide general health information, but this does not constitute a doctor-patient relationship or ongoing medical care.
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. We are committed to protecting your personal and health information in accordance with applicable privacy laws, including HIPAA. By using our services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.
All content on our website and in our materials, including text, graphics, logos, images, and software, is the property of LabNow or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include but are not limited to: providing false or misleading information, attempting to gain unauthorized access to our systems, interfering with other users' use of our services, transmitting viruses or malicious code, or violating any applicable laws or regulations.
Our services may integrate with or link to third-party services, including scheduling platforms, payment processors, and laboratories. We are not responsible for the content, privacy practices, or terms of service of these third parties. Your use of third-party services is at your own risk and subject to their respective terms and policies.
TO THE FULLEST EXTENT PERMITTED BY LAW, LABNOW AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. LABORATORY RESULTS ARE PROVIDED BY INDEPENDENT THIRD-PARTY LABORATORIES, AND WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF SUCH RESULTS.
You agree to indemnify, defend, and hold harmless LabNow and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms of Service, or your violation of any rights of another party.
Any dispute arising out of or relating to these Terms of Service or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits. Arbitration shall take place in Bergen County, New Jersey. Notwithstanding the foregoing, either party may seek injunctive relief in court to protect intellectual property rights.
These Terms of Service shall be governed by and construed in accordance with the laws of New Jersey, without regard to its conflict of law provisions. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in Bergen County, New Jersey.
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website with a new effective date. Your continued use of our services after changes are posted constitutes your acceptance of the modified terms. If you do not agree to the modified terms, you must discontinue use of our services.
We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, including for violation of these Terms of Service. Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to liability limitations, indemnification, and dispute resolution.
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and LabNow regarding your use of our services and supersede all prior agreements and understandings.
